Welcome to MyFencing24. These Terms of Service (the “Terms”) form a binding legal agreement between Myfencing24 doing business as MyFencing24 and any person who accesses, browses, purchases from, subscribes to, or otherwise uses the website, digital products, subscription materials, private-access pages, protected libraries, email-delivered resources, or related services made available by MyFencing24 (collectively, the “Service”).
By accessing or using the Service, or by purchasing any product, subscription, or paid access offered through the Service, you acknowledge that you have read, understood, and agreed to be bound by these Terms and by our Privacy Policy. If you do not agree, you must not access or use the Service.
1. Eligibility and Permitted Use
You represent and warrant that you are legally capable of entering into a binding agreement under applicable law. If you are using the Service on behalf of an entity, organization, team, or other person, you represent and warrant that you have authority to bind that party to these Terms, and references to “you” include that party.
The Service is offered only for lawful use and only for users who comply with these Terms.
2. Definitions
For purposes of these Terms:
“Content” means all materials made available through the Service, including text, written frameworks, systems, concepts, diagrams, maps, structures, sequences, plans, methodologies, branding, page designs, graphics, downloads, subscriber materials, and all other intellectual property or protected material.
“Digital Product” means any non-physical product, paid resource, premium written material, framework, guide, download, subscriber-only material, access right, or other digital offering made available by MyFencing24.
“Subscription” means any recurring or continuing paid access to Content or portions of the Service for a stated billing cycle.
“Private Access Content” means any Content made available through email-delivered links, password-protected pages, private libraries, secure links, or similar restricted-access methods.
“Purchase” means any order, payment, subscription enrollment, or other transaction completed through the Service.
3. Description of the Service
MyFencing24 is a digital fencing information and education platform offering written tactical, strategic, conceptual, organizational, and training-related materials. The Service may include digital products, paid subscriptions, premium written frameworks, schedules, plans, systems, diagrams, conceptual maps, or other educational and informational resources.
Unless expressly stated otherwise in writing, the Service does not provide guaranteed coaching outcomes, guaranteed athletic results, guaranteed competition victories, guaranteed rankings, guaranteed admissions outcomes, medical advice, legal advice, psychological counseling, or individualized professional advice.
4. Acceptance of Electronic Terms and Records
You agree that these Terms, all policies incorporated into them, acknowledgments, disclosures, notices, and transaction records may be provided electronically. To the fullest extent permitted by applicable law, your electronic assent, continued access, purchase, or use of the Service constitutes your agreement to receive records and enter into agreements electronically.
You are responsible for retaining copies of these Terms and any transaction confirmations made available to you.
5. Privacy Policy
Your use of the Service is also subject to our Privacy Policy, which is incorporated into these Terms by reference. In the event of a conflict between these Terms and the Privacy Policy with respect to contractual use rights and limitations, these Terms control.
6. Changes to the Service and to These Terms
We reserve the right to modify, update, replace, suspend, discontinue, or remove any part of the Service, any Content, any Digital Product, any pricing structure, any Subscription offering, or any delivery method at any time, in our discretion and in good faith.
We may also revise these Terms from time to time. The updated version will become effective when posted or when otherwise communicated to you, unless a later effective date is stated. Where required by applicable law, or where changes are material, we will provide additional notice by reasonable means. Your continued use of the Service after the effective date of updated Terms constitutes acceptance of the revised Terms, except where additional consent is required by law.
7. Orders, Pricing, and Payment Processing
All prices, fees, subscription rates, and charges are listed in the currency identified at checkout unless otherwise stated. You agree to pay all amounts due in connection with your Purchase, including any applicable taxes, fees, or charges disclosed at checkout.
All payments made through the Service are processed through third-party payment providers, including but not limited to Stripe and PayPal. By submitting payment information, you authorize the applicable payment processor to charge your selected payment method for the full amount due, including any applicable taxes, fees, recurring charges, or other disclosed amounts.
MyFencing24 does not directly store or control full payment card information and is not responsible for errors, declines, delays, security failures, interruptions, or processing failures caused by third-party payment processors, banks, card issuers, payment networks, or other third parties outside our reasonable control.
You are responsible for providing complete, current, and accurate billing, payment, and contact information at the time of Purchase.
8. No Account Required; Access Triggered by Successful Payment
The Service may permit Purchases without requiring the creation of a user account or customer profile. Access to purchased Digital Products or Private Access Content is granted only after successful payment authorization and confirmation.
No product, license, subscription right, or access right is deemed delivered, transferred, or activated until payment has been fully received and accepted. If any payment is declined, reversed, disputed, refunded, interrupted, not successfully completed, or later determined to be unauthorized, MyFencing24 may withhold, suspend, limit, terminate, or revoke related access without further obligation.
9. Digital Delivery
Digital Products and paid access may be delivered by email, secure link, password-protected page, private library, downloadable file, subscriber-only access point, or another digital delivery method selected by MyFencing24.
You are solely responsible for providing a valid and deliverable email address, monitoring your inbox and spam or junk folders, and following any access instructions we provide. Delivery is deemed complete when the applicable Content, link, access instruction, or access pathway has been sent or otherwise made available by MyFencing24.
We will use commercially reasonable efforts to provide delivery within any stated or reasonably expected timeframe, but delivery timing may be affected by payment verification, email routing issues, technical maintenance, third-party platform delays, security reviews, force majeure events, or other factors outside our reasonable control.
A Digital Product will not be deemed undelivered solely because you failed to locate an email, provided incorrect contact information, blocked communications, lost access to the email address supplied, or failed to follow instructions properly. Where reasonably possible, we may attempt re-delivery or alternate instructions, but we are not obligated to do so indefinitely or outside a reasonable support period.
10. Subscriptions, Renewals, and Cancellation
This Section applies only if MyFencing24 offers a Subscription product.
If you enroll in a Subscription, you agree to the billing frequency, renewal terms, pricing, and cancellation terms disclosed to you at the time of enrollment. Unless otherwise stated at the time of purchase and to the fullest extent permitted by applicable law, a Subscription may renew automatically at the end of each billing cycle until canceled.
You authorize MyFencing24 and its payment processors to charge your selected payment method for each recurring billing cycle unless and until the Subscription is canceled in accordance with the disclosed cancellation process.
You may cancel your Subscription using the cancellation method made available by MyFencing24 at the time of enrollment, in your subscription confirmation, or on the Service. Unless otherwise stated by applicable law or the specific offer terms, cancellation will stop future renewals but will not entitle you to a refund for the current billing period already paid.
If a Subscription payment fails, expires, is declined, is reversed, or is disputed, we may suspend or terminate access immediately and without liability unless and until the payment issue is resolved.
Where required by applicable law, MyFencing24 will provide subscription-related disclosures, acknowledgments, renewal notices, fee-change notices, and cancellation mechanisms in the manner required by applicable law.
11. Refund Policy and Final Sale Terms
Because the Service offers Digital Products, Subscription materials, private-access resources, and immediately accessible intellectual property, all sales are final and non-refundable unless otherwise expressly stated in writing by MyFencing24 or required by applicable law.
Once digital access, delivery instructions, password access, subscriber entry, downloadable material, protected Content, or other paid access has been made available, you acknowledge that the applicable product or service is deemed delivered.
No refund, reversal, credit, or partial reimbursement will be owed once access has been delivered or made available, except where required by mandatory law.
You agree not to initiate any bad-faith, abusive, or unwarranted chargeback, payment reversal, or refund claim after receiving access to digital materials. In the event of a payment dispute, suspected fraud, abuse, or unauthorized chargeback, MyFencing24 reserves the right to suspend delivery, revoke access, terminate current or future eligibility to purchase, and pursue any lawful or equitable remedy available.
12. Ownership and Full Reservation of Rights
All Content, materials, frameworks, written systems, diagrams, concepts, models, training structures, strategic maps, methodologies, branding, visual layouts, downloadable resources, and all related intellectual property made available through the Service are and shall remain the exclusive property of MyFencing24 and its licensors, protected by applicable copyright, trademark, trade secret, unfair competition, and other intellectual property laws.
No ownership rights are transferred to you at any time. Access to the Service constitutes only a limited permission to use the Content as expressly authorized under these Terms. All rights not expressly granted are strictly reserved.
13. Limited License
Subject to these Terms, MyFencing24 grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Content solely for your personal, internal, non-commercial use, unless a separate written license expressly states otherwise.
You may not copy, reproduce, modify, translate, adapt, republish, upload, post, transmit, distribute, display, sell, license, exploit, reverse-engineer, repurpose, or create derivative works from any portion of the Service or its Content without prior written consent from MyFencing24.
This restriction includes converting any portion of the Content into courses, coaching systems, guides, prompts, datasets, databases, teaching materials, subscription products, written resources, or any competing or substitute commercial offering.
14. No Extraction, Scraping, AI Training, or Strategic Replication
You shall not use any part of the Service or its Content for data mining, scraping, harvesting, automated extraction, archiving, mirroring, prompt extraction, model training, machine learning input, algorithmic development, knowledge-base construction, or any manual or automated process intended to reconstruct, imitate, replicate, extract, or commercialize the logic, structure, sequence, organization, or strategic value of the Service.
This prohibition applies not only to literal copying, but also to the extraction or reproduction of the substance, architecture, commercial essence, instructional logic, sequencing, or protected value of the Content in any medium or format.
MyFencing24 may seek immediate injunctive, equitable, or other relief for any actual or threatened violation of this Section, in addition to any other remedies available at law or in equity.
15. No Sharing of Protected Access
Any password, secure link, subscriber entry, private page access, or other Protected Access Content made available to you is personal, confidential, and non-transferable unless expressly authorized in writing by MyFencing24.
You may not share, publish, forward, repost, distribute, sublicense, resell, or otherwise make Protected Access Content available to any third party. Any unauthorized sharing, forwarding, credential distribution, access laundering, group use beyond the purchased scope, or similar conduct constitutes a material breach of these Terms and may result in immediate suspension or termination without refund.
16. Acceptable Use Restrictions
You agree not to use the Service:
in violation of any law or regulation;
to infringe, misappropriate, dilute, or violate intellectual property or proprietary rights;
to interfere with, disrupt, damage, disable, overburden, or compromise the Service or any related system;
to bypass security measures, access restrictions, or technological controls;
to impersonate another person or misrepresent your affiliation;
to use the Service in a fraudulent, deceptive, abusive, harassing, or commercially exploitative manner;
to test, benchmark, mine, or analyze the Service for the purpose of building a competing or substitute product, service, library, training system, or commercial offering.
17. User Communications and Submitted Materials
If you send us any email, inquiry, feedback, suggestion, idea, review, testimonial, or other communication, you grant MyFencing24 a non-exclusive, worldwide, royalty-free license to use, reproduce, display, adapt, and publish that communication for customer service, internal operations, legal compliance, marketing, or business improvement purposes, provided that personal information will be handled in accordance with our Privacy Policy.
Do not submit confidential business information, third-party protected content, or unlawful material through the Service or related contact channels unless specifically requested by MyFencing24 in writing.
18. Educational Nature of the Service; No Guaranteed Outcomes
The Service is educational, informational, and conceptual in nature. MyFencing24 does not guarantee any specific result, competitive success, tactical success, athletic outcome, ranking outcome, selection outcome, admissions outcome, financial outcome, or other performance outcome arising from the use of the Service.
Your use of any information or Content is at your own discretion and risk. You remain solely responsible for how you interpret, apply, adapt, or implement any Content obtained through the Service.
19. Disclaimer of Warranties
To the fullest extent permitted by applicable law, the Service and all Content, Digital Products, subscriptions, links, delivery systems, and materials are provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied, statutory, or otherwise.
MyFencing24 disclaims, to the fullest extent permitted by applicable law, all warranties including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, uninterrupted access, error-free performance, and results obtained from use of the Service.
We do not warrant that the Service will always be available, timely, secure, uninterrupted, error-free, or compatible with every browser, device, payment method, or email system.
20. Limitation of Liability
To the fullest extent permitted by applicable law, MyFencing24 and its owners, affiliates, licensors, contractors, service providers, officers, directors, employees, agents, successors, and assigns shall not be liable for any indirect, incidental, consequential, special, exemplary, punitive, or enhanced damages, or for any loss of profits, loss of revenue, loss of data, loss of business opportunity, interruption, or goodwill, arising out of or relating to the Service, even if advised of the possibility of such damages.
To the fullest extent permitted by applicable law, MyFencing24’s total aggregate liability arising out of or relating to the Service or these Terms shall not exceed the greater of: (a) the amount you paid to MyFencing24 for the specific Digital Product or Subscription giving rise to the claim during the three (3) months immediately preceding the event giving rise to the claim; or (b) one hundred U.S. dollars (US $100).
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under applicable law.
21. Indemnification
You agree to defend, indemnify, and hold harmless MyFencing24 and its owners, affiliates, licensors, contractors, service providers, officers, directors, employees, agents, successors, and assigns from and against any claims, demands, actions, losses, liabilities, damages, judgments, settlements, penalties, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to:
your breach of these Terms;
your misuse of the Service;
your violation of any law or regulation;
your infringement, misappropriation, or violation of any rights of another person or entity;
your unauthorized sharing, reproduction, or commercialization of the Content.
22. Suspension and Termination
MyFencing24 may, in its sole discretion and without prior notice where permitted by law, suspend, restrict, or terminate your access to all or part of the Service if we reasonably believe that you have violated these Terms, engaged in fraud, initiated abusive chargebacks, shared protected access improperly, infringed intellectual property rights, interfered with the Service, or otherwise created legal, operational, or reputational risk.
Termination or suspension does not waive or limit any rights or remedies available to MyFencing24.
Upon termination, all rights granted to you under these Terms cease immediately. Sections that by their nature should survive termination will survive, including without limitation payment obligations, refund rules, intellectual property protections, disclaimers, limitations of liability, indemnification, dispute provisions, and miscellaneous provisions.
23. International Use
The Service may be accessed from multiple jurisdictions. You are responsible for ensuring that your use of the Service complies with the laws applicable to you in your location. We make no representation that the Service is appropriate or lawful in every jurisdiction.
24. Force Majeure
MyFencing24 shall not be liable for any delay, interruption, failure, or inability to perform resulting from causes beyond its reasonable control, including acts of God, natural disaster, epidemic, cyberattack, labor disruption, war, civil disturbance, government action, infrastructure outage, internet failure, third-party platform failure, payment processor failure, hosting outage, or similar events.
25. Miscellaneous
These Terms constitute the entire agreement between you and MyFencing24 regarding the Service and supersede all prior or contemporaneous understandings relating to the same subject matter, except for any separate written agreement signed by an authorized representative of MyFencing24.
If any provision of these Terms is held invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect to the fullest extent permitted by law.
No waiver of any provision or breach shall be deemed a waiver of any other provision or breach.
You may not assign, transfer, delegate, or sublicense any rights or obligations under these Terms without MyFencing24’s prior written consent. MyFencing24 may assign these Terms in connection with a merger, acquisition, restructuring, sale of assets, or by operation of law.
